LAHORE High Court Chief Justice Umer Ata Bandial on Monday dismissed a petition filed by Hamesh Khan, the key accused in the Bank of Punjab loan scam, seeking transfer of his case after levelling charges of partiality on the trial judge.
The LHC chief justice on Monday reviewed the statements submitted by a judge of an accountability court, Nisar Baig, and Hamesh Khan. The accountability court judge stated that Hamesh was facing the trial according to the law and his request, seeking transfer of the trial was baseless.
Hamesh, in the petition, had alleged that the said judge had not been holding proceedings in the case as per the law and appeared to have become biased against him. He said the judge was recording the statements of witnesses within his chamber instead of the open court while the pace of recording the statements was also very slow. He added that statements of only 11 witnesses out of 129 had been recorded so far which was also against the directions of the Supreme Court in which speedy trial was directed. Hamesh and others are accused of sanctioning billions of rupees loans in violation of the BoP rules. He was arrested in Dec 2009 from the US with the help of Interpol.
