PHC CJ sees a wave of positive change despite all ills

PESHAWAR: Chief Justice of the Peshawar High Court (PHC) Justice Dost Muhammad Khan said on Thursday that a positive change was being witnessed in the country despite poor governance, corruption, nepotism and people’s frustration at large.

“Today we are confronting a host of challenges including poor administration. We should admit that poor governance, corruption and nepotism are prevailing [in the society] and that people are facing frustration at large, but there is one positive sign which is the change of mind of the civil society. Previously, when situation would reach such a stage, the civil society would invite generals for rescue, but today they have come to the judiciary to intervene and rescue them from the situation,” the chief justice said in his address to the concluding ceremony of one-week training of the judicial officers in “Judgment Writing” at the Khyber Pakhtunkhwa Judicial Academy.

The chief justice added that democracy was flourishing in the country due to the positive change of mind of the people.“We want a strong democratic system, but at the same time we will maintain a check on the government so that the law and Constitution is not violated,” he said. He said sometimes judicial intervention in violation of fundamental rights and public importance cases becomes necessary due to people’s frustration.

He said with the support of media and civil society the judiciary delivered effectively and those who considered themselves above the law were touched by the independent judiciary and brought into the ambit of the law and Constitution. “Everyone should clearly understand that there will be the rule of law and not rule of rulers in the country,” the chief justice remarked.

Justice Dost Mohammad said: “We are avoiding passing judicial orders that lead to confrontation. We convey a massage to the authorities for reformation through statements and observations. We have the powers to pass an order against the wrong doers and violators of the law and Constitution.”

The chief justice felt peace and tranquillity could be restored in the country through the rule of law. He said the foreign investors come to a country for investment when there is legal protection to them.

He contended that the judiciary was united right from the judges of Supreme Court to the judicial magistrates. He said the judiciary’s sole aim was to maintain the rule of law and supremacy of the Constitution along with dispensation of quick and inexpensive justice to the people at their doorsteps.

Director General, Khyber Pakhtunkhwa Judicial Academy, Hayat Ali Shah in his welcome address stated that in the short span of time the academy had conducted three trainings in effective and quality judgment writing and trained 75 judicial officers across the province.

He said peace could only be maintained through the rule of law that could be ensured through competent judges, who needed legal professional skills and knowledge related to every aspect. The official said the academy had also trained judges from Malakand region in writing judgments related to the Sharia laws.

Representative of UNDP, Sharmila Rasool, secretary Communication and Works Department and Advocate General Khyber Pakhtunkhwa Khalid Khan also attended the ceremony
