ISLAMABAD: Chief Justice Iftikhar Muhammad Chaudhry has said that the superior judiciary is a role model for all the institutions with regard to service delivery, commitment of purpose, adherence to masses welfare and upholding of rule of law so all the state organs should follow the guidelines the apex court devised for itself as no single institution could ensure good governance.
He said that the superior judiciary enjoyed the cross-cutting jurisdiction empowering it to carry out the oversight role and ensure that no institution or department or authority might interfere in the domain of the other.
Addressing the full court meeting held here in the Supreme Court on Thursday, the chief justice said that the apex court was also empowered to check the unlawful or unauthorised or mala fide act or exercise of any authority.
The chief justice said that this power of the apex court known as power of judicial review was a sacred trust which must be exercised in an independent and effective manner.
“It is a duty cast on the judiciary and the courts have to discharge it without fear or favour,” the chief justice maintained.
He said that the Supreme Court was a constitutional body which had constitutionally guaranteed jurisdictions like appellate, review, original and advisory.The chief justice said that as per prescribed principles enshrined in the Constitution, every organ of the state had to perform its duties and functions within the mandated sphere. “Institutions also strive to excel the others and perform better, which is a welcome sign, as it is for better delivery and service to the people,” he remarked.
He said the present day judiciary was looked upon as an institution which was delivering the services to the people in an active manner. Therefore, he said it was incumbent upon the judiciary to come up to the peoples’ expectations and become a role model for all other institutions to follow.
“Although one institution has not the capacity to provide good governance single-handedly, yet the institution of the judiciary due to its credibility and institutional mandate can inspire all others to do their duties in a transparent manner keeping in view the interest of people of Pakistan”, the CJP said.
The full court meeting was attended by Justice Tassaduq Hussain Jillani, Justice Nasir-ul-Mulk, Justice Anwar Zaheer Jamali, Justice Khilji Arif Hussain, Justice Tariq Parvez, Justice Mian Saqib Nisar, Justice Asif Saeed Khan Khosa, Justice Sarmad Jalal Osmany, Justice Amir Hani Muslim, Justice Ejaz Afzal Khan, Justice Ijaz Ahmed Chaudhry, Justice Gulzar Ahmed, and Justice Sh Azmat Saeed.
Earlier, the chief justice while welcoming the participants of the full court meeting said that the object was to improve the court functioning and ensure speedy justice to those who approached the court seeking relief for violation of their rights.
The chief justice said that despite the disposal of significant number of cases due to the hard work of his brother judges, there was rising trend file cases, both under the regular jurisdiction and public interest litigation under article 184 (3) of the Constitution.
Meanwhile, the full court noted that out of total 13,653 cases filed from January 01, 2012 to November 10, 2012 in the Supreme Court, the court decided 12,377 cases during the said period. The court noted with satisfaction that almost as many cases were decided as were filed.
This success, the full court observed was due to the untiring efforts of the judges who worked beyond the working hours and even during the summer vacation. The full court however, noted that there remained the pendence of cases for which the court resolved to formulate appropriate strategies for quick disposal of the cases.
The meeting resolved that three 2-member benches, two at Lahore and one at Peshawar be constituted to clear the backlog for the period of three months. Further, two and three-member benches will be constituted at the principal seat, Islamabad.
Meanwhile, the full court granted Syed Sami Ahmad, Mushtaq Ali Tahir Kheli, Akhter Hussain and Yaseen Azad, the status of senior advocate of the Supreme Court.The meeting also decided to hold an International Judicial Conference in the 3rd week of April, 2013 as per tradition established by the apex court.
The meeting further decided that a committee comprising four senior most judges of Supreme Court should be authorised to take all necessary decisions for successful holding of the said conference.
