PBC concerned over contempt jurisdiction trend

ISLAMABAD: Pakistan Bar Council (PBC) on Friday expressed grave concern over the growing trend of contempt jurisdiction at superior courts’ level saying that it may affect the constitutional rights of citizens to make fair comments on judgments of superior courts.

A joint meeting of chairman and members of Central Free Legal Aid Committee of the Pakistan Bar Council with chairmen of Free Legal Aid Committees of Provincial Bar Councils held in the Office of the Pakistan Bar Council, Supreme Court Building. The meeting was chaired by Muhammad Ramzan Chaudhry.

The meeting in a resolution passed on the occasion expressed grave concern over the growing trend of contempt jurisdiction at superior courts’ level. The meeting observed that contempt laws are to be used sparingly and in rare cases as the frequent exercise of this jurisdiction may affect the judiciary as a respected and esteemed institution.

The resolution said that the same may affect the constitutional rights of citizens to make fair comments on judgments of superior courts.

The meeting was attended by Jam Muhammad Younas, Chairman Legal Aid Committee Punjab Bar Council, Noor Naz Agha, Chairman Sindh Bar Council as well as members.

Earlier, the meeting while considering the matter of effective implementation of the Pakistan Bar Council Free Legal Aid Rules, for providing free legal aid to poor and needy litigants at different levels, decided to establish Free Legal Aid Committees at provincial and district level giving effective representation to Provincial Bar Councils and High Court and District Bar Associations. It was also resolved to establish Free Legal Aid Cells of the Pakistan Bar Council in Provincial Bar Councils at all the four Provincial Capitals.

Similarly, in order to facilitate the poor and needy litigants, it was also resolved to install drop boxes in premises of High Court and District Bar Associations throughout the country depicting “PBC Free Legal Aid Scheme”, facilitating the needy and deserving poor litigants to drop their applications for free legal aid which would be examined and scrutinized by learned presidents of respective Bar Associations and those found by them genuine and really deserving would be transmitted to the Central Free Legal Aid Committee of the Pakistan Bar Council for providing free legal aid.
