DIG declares own probe body illegal

‘Fake’ police encounter

THE head of the inquiry committee, constituted to probe Ghalib Market Police encounter, has declared the committee illegal and suggested to the IG Punjab that a judicial inquiry should be conducted into the incident as per the law.

DIG Zulfiqar Cheema, who was appointed head of the inquiry committee by Inspector General of Police, Punjab, Haji Habibur Rehman, has written a letter to the IG on the issue.

Zulfiqar Cheema told The News that the law did not permit police to conduct a probe into the police encounter in which an accused person was killed.

He explained that the Judicial Inquiry into a police encounter of said nature was a legal requirement. The DIG went on to say that the police inquiry into the said incident, if conducted, would have no value according to the law.

It is also learnt that the IGP has agreed upon the recommendation of DIG Cheema and directed Lahore CCPO Aslam Tarin to forward a request to the district & sessions judge Lahore for holding a judicial inquiry into the police encounter held in Ghalib Market.

Sources in Lahore Police said that the Lahore CCPO had also forwarded the request to the district and sessions judge for holding a judicial inquiry into the alleged fake encounter.

On December 7, 2012, Ghalib Market police had killed a youth, identified as Mohsin Abbas of Chakwal, in an alleged encounter. On December 8, the CCTV footage obtained from the street where the encounter had taken was aired on electronic media. The CCTV footage made the encounter suspicious as the activities of police were fishy in the video. However, senior officers of Lahore Police had claimed that the encounter was genuine. The statements of clinic doctor and other eyewitnesses had also supported the police point of view.

Chief Minister Shahbaz Sharif had taken notice of the incident and ordered the IGP to furnish an inquiry report on the incident.

The IGP constituted an inquiry team, headed by DIG Abu Bakar Khuda Bukhsh but later DIG Zulfiqar Cheema was appointed as head of the inquiry team. However, now a judicial inquiry into the incident would ascertain whether the encounter was genuine or fake.
