LHC rejects plea against mobile service suspension

THE Lahore High Court on Friday turned down plea of a leading mobile telecommunications company to issue a stay against suspension of mobile service during Ashura (9th and 10th Muharram).

Justice Ijazul Ahsan remarked that the matter involved national security and the court could not issue an injunctive order without hearing the point of view of the government. The judge sought replies from the federal government and Pakistan Telecommunication Authority (PTA) by the next week. The petitioner, through its counsel, argued that the PTA had introduced a new SOP (standard operating procedure) on February 15, 2010 and decided that the mobile companies could be directed to suspend/close their service. The counsel pointed out that the petitioner (company), on the direction of the respondents, had suspended its service five times on different occasions during the current year and suffered a financial lose of Rs95.76 million during the last five closures of the service. He said the Interior Ministry had issued notification regarding shutting mobile phone service and the company’s 120 million subscribers would suffer from the ban. The counsel stated that the petitioner (company) had already told the government that it would not suspend mobile service wholly or partially except required by the law and without prior agreement and payment of compensation by the PTA. He said the government was again preparing to ask the company for a shutdown of mobile service in major cities on 9th and 10th Muharram. He argued that the service could only be closed if the President proclaimed emergency but only on payment of appropriate compensation. The counsel requested the court to issue a stay against the suspension of the mobile service and also declared the SOP introduced by the PTA as illegal and in violation of fundamental rights. Justice Ahsan, however, refused to issue a stay in this regard and directed a deputy attorney general to ensure replies of respondents on next hearing.

Notice issued to MNA: The Lahore High Court on Friday again issued notice to PML-Q MNA Chaudhry Liaqat Bhatti on a petition, seeking his disqualification for having a bogus graduation degree.

Justice Nasir Saeed Sheikh issued the notice to the respondent, as no one on his behalf appeared before the court.

The court also directed the Speaker National Assembly to ensure the compliance of the notice by the respondent MNA.

Petitioner Ahmed Waheed Khan in the petition had submitted that the MNA participated in the election on the basis of the bogus graduation degree in 2008.

He said according to the Article 62 and 63, the MNA stood disqualified for not being the Ameen (honest) by concealing the facts.
