Court moved against six ex-MPs for hiding facts from ECP

LAHORE: The Election Commission has moved the session courts against six parliamentarians, who recently resigned for having dual nationalities, and requested the court to initiate legal proceedings against them for hiding facts from the ECP.

Despite resigning from their seats, the parliamentarians are still not out of hot waters as the ECP wants to complete legal procedure against them on the charge of submitting false certificates on account of their dual nationalities.

In this regard, the Punjab office of the ECP moved letters to six districts and session judges for initiating legal procedure against the former MNAs and MPAs, including: Chaudhary Zahid Iqbal of NA-102 Sahiwal having an affiliation with PPPP and nationality of the UK; PML-N’s Jamil Malik, NA -107, Gujrat; and Amina Butter affiliation with PPP (reserved seat) and having nationality of the USA; PML-N’s Chaudhary Nadeem Khadim, PA-26 Jehlum, nationality UK; PML-N’s Dr Muhammad Ashraf Chauhan, PP-92 Gujranwala, nationality UK; and Muhammad Akhlaq, PP-112 Sialkot, nationality US. The district and sessions judges in the respective districts have been moved against ex-parliamentarians.

As per a communique issued by ECP Islamabad office to the ECP Punjab, dated September 24, 2012, directions were issued to file complaints against the parliamentarians on account of commission of corrupt practices according to sections 78 and 82 of Peoples Representative Act 1976 and PPC sections, including 193 (submitting false evidence), 196 (using evidence known to be false), 197(signing a false certificate), 198 (Using as true a certificate known to be false) and 199 (false statement made in declaration which is by law receivable as evidence).

Later, the ECP Punjab office filed complaints in the respective courts stating the former MNAs and MPAs had contested in 2008 polls. It was further stated that the parliamentarians had filed their nomination papers before the returning officers for the respective seats declaring on oath that they were qualified under Article 62 and were not subject to any disqualification.
